House Bill 1059: Public School Health Curriculum
This bill would correct certain medical and legal inaccuracies in the law governing the so-called "Abstinence Until Marriage" curriculum in public schools.
- Status: Passed House in 2005; Senate placed provisions of this bill in the 2005 Technical Corrections Act, which passed in 2006. The content of H1059 was stripped and used in 2006 to pass legislation on other matters.

This bill would amend the state's Abstinence Until Marriage sex education curriculum in the public schools to correct some of the medical and legal inaccuracies in the existing law. The existing law contains factually inaccurate information about HIV/AIDS and the transmission of sexually transmitted diseases, which the bill addresses.
The law also requires teachers to tell students the "legal status" of "homosexual acts." North Carolina law has never defined or proscribed homosexual acts. This clause apparently referrs to the Crime Against Nature law, which criminalized certain sexual acts for both same- and opposite-sex couples. This law is no longer valid following the U.S. Supreme Court's decision in Lawrence v. Texas.
The bill, which passed the House on June 1 with broad bipartisan support, was sponsored by Rep. Thomas Wright (D-New Hanover). The bill is now in the Senate for their consideration..
